Under New York Agriculture and Markets Law Article 20-C and the Home Processor Exemption, residents can produce certain low-risk foods (baked goods, jams, candies, dry mixes) in a home kitchen with state registration through NYS Dept of Agriculture and Markets. Labels must include producer name, address, and Not inspected by the NYS Dept of Agriculture and Markets Food Safety Inspection. Sales allowed direct to consumer at farmers markets, online, and from home. Annual gross sales capped (currently $50,000 under the exemption). Huntington home occupation zoning (Chapter 198) also applies and limits customer foot traffic at the residence.
Selling non-approved food categories or without proper labeling violates Article 20-C; zoning violations separate.
