Oregon's domestic-kitchen exemption under ORS 616.706 lets home producers sell certain non-potentially-hazardous foods directly to consumers without a food establishment license, subject to a $50,000 annual sales cap and labeling rules enforced statewide by ODA.
ORS 616.706 and OAR 603-025-0700 allow Oregonians to sell low-risk foods such as baked goods, jams, candies, and dried herbs from a home kitchen without an Oregon Department of Agriculture food establishment license. Annual gross sales cannot exceed $50,000, sales must be direct to the end consumer (no wholesale or interstate), and each package must bear a label naming the producer, address, ingredients, allergens, and the statement that the food was made in a home kitchen not licensed by ODA. Potentially hazardous foods like meats, dairy, and canned low-acid vegetables remain prohibited under the exemption.
Selling above $50,000, distributing through retailers, or omitting the home-kitchen disclosure label can trigger ODA enforcement, civil penalties under ORS 616.992, and loss of the exemption.
