Pima County, AZ Home Business: Cottage Food Operations (2026)

ARS 36-1761 establishes Arizona as one of the most permissive states for cottage food operations. Residents of unincorporated Pima County may produce and sell non-potentially-hazardous food items (baked goods, candies, jams, dried fruits, granola, honey, roasted nuts, and similar shelf-stable products) from their home kitchen without a county health permit, commercial kitchen certification, or food handler card. The annual gross revenue cap is $75,000. Products must be sold directly to consumers (farmers markets, online with direct delivery, or from the home). Wholesale to stores or restaurants is prohibited. Each product must be labeled with the producer's name, home address, the statement 'Made in a Home Kitchen That Is Not Subject to Government Food Safety Inspection,' and any major allergens present. Pima County Health Department does not inspect or license cottage food operations. Potentially hazardous foods requiring refrigeration (such as dairy-based items, meat, or cut fruit) are excluded from the cottage food exemption.
