Arizona Cottage Food Program under ARS 36-136.C allows home production of non-hazardous baked goods, candies, jams, dry mixes, and similar items for sale directly to consumers. Tucson participants must register with Arizona Department of Health Services, complete a food handler course, and label products with required disclosures.
Allowed products are shelf-stable items that do not require refrigeration. Prohibited items include cheeses, cooked meats, cream-filled bakery, and anything requiring time and temperature control. Annual gross sales are capped at 25,000 dollars under the registration, though Arizona revised the law in 2022 to expand categories. Products must carry a label with the producer name, address, a statement that the food is prepared in a home kitchen not inspected by a regulatory authority, and ingredients. Sales must be direct to consumer in Arizona only; wholesale and out-of-state sales are prohibited.
Operating without registration is a state-level violation. Tucson does not add separate permit requirements, but home occupation rules still apply, so drop-in retail from the home is not permitted.
