Michigan Cottage Food Law (MCL 289.4105) allows Wayne County residents to sell non-hazardous homemade foods up to 25,000 dollars per year without a license or inspection. Direct-to-consumer sales only.
Michigan Cottage Food Law, codified at MCL 289.4105, permits Wayne County residents to produce and sell non-potentially hazardous foods from a home kitchen without obtaining a food establishment license or undergoing MDARD inspection. Annual gross sales are capped at 25,000 dollars. Allowed products include baked goods (breads, cookies, cakes without cream fillings), jams, jellies, dry herbs, dry mixes, granola, roasted coffee beans, and candies. Prohibited items include meat, poultry, seafood, dairy, cut melons, low-acid canned goods, salsas, fermented foods, and anything requiring temperature control. Sales must be direct-to-consumer at farmers markets, roadside stands, community events, or from the home. Online orders are permitted but delivery must be in-person, not shipped through the mail. Products must bear a label with producer name, address, ingredients, allergens, and the statement MADE IN A HOME KITCHEN THAT HAS NOT BEEN INSPECTED BY THE MICHIGAN DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT. Wayne County does not add local cottage food requirements, but municipal zoning still applies.
