A home occupation in Idaho Falls is an administrative conditional use that requires approval before operating, with the applicant signing a statement that all conditions are met. Approval becomes null and void immediately if conditions are violated. Several uses, such as medical offices and on-site retail, are banned as home occupations.
In Idaho Falls, 'Home Occupation' is listed as an administrative conditional use (C1) in all residential zones under Zoning Code Table 11-2-1, and the standards are in Section 11-2-6(R). Before issuance, the applicant must sign a statement verifying that all requirements and conditions for approval are met, and acknowledging that if any requirement or condition is violated, the approval 'shall become null and void, immediately and without further process due' (Section 11-2-6(R)(10)). Operating conditions include conducting the business entirely within the dwelling or an accessory structure, using no more than 20% of the floor area, employing only residents (with limited exceptions), no outdoor storage, no large commercial-vehicle parking, and maintaining residential character and parking demand. Section 11-2-6(R)(11) prohibits certain uses as home occupations in residential zones, including medical or dental offices; motor vehicle and engine repair and body shops; animal medical, care, or boarding facilities; dispatch centers; machine shops and metal working; on-site retail sales; commercial food preparation (not including catering); contractors' shops; mortuaries; body piercing, painting, or tattoo; and any business requiring storage or manufacturing of toxic or hazardous materials, including ammunition or gunpowder. Several low-impact activities, such as home offices with no client visits and private instruction limited to one student at a time, do not require a home occupation at all. Apply and confirm requirements through Community Development Services.
Operating a prohibited use as a home occupation, or breaching any home-occupation condition, voids the approval immediately under Section 11-2-6(R)(10). Continuing to operate after the approval is void is a Zoning Code violation subject to enforcement and penalties under Title 11.
