Idaho Falls City Code Title 6, Chapter 2 (last amended Ord. 3365, 1-14-21) adopts NFPA 1123 and regulates fireworks. Section 6-2-3 defines 'safe and sane fireworks' as non-aerial items: cone and cylindrical fountains, ground sparklers, snakes, wheels, and whistles within stated pyrotechnic limits. Section 6-2-2(A)(2) classifies 'dangerous fireworks' to include firecrackers, skyrockets, rockets, Roman candles, chasers, aerial shells and any device that rises into the air. Per City Code 6-2-4, it is unlawful to possess, keep, store, use or discharge any dangerous fireworks within the City unless the person holds a valid 'Fireworks Permit for Public Display.' Idaho Code 39-2602(6) defines 'nonaerial common fireworks' as those staying within a 15-foot circle and not emitting material above 20 feet, and Idaho Code 39-2606 authorizes retail sale and use of non-aerial common fireworks only from midnight June 23 to midnight July 5 (and midnight Dec 26 to midnight Jan 1). The state allows aerial fireworks to be SOLD with the buyer signing a statement, but Idaho Falls City Code 6-2-4 makes discharging them in the City unlawful absent a display permit. Selling 'safe and sane' fireworks requires a City permit issued by the Fire Code Official (6-2-5).
Under Idaho Code 39-2609, using fireworks at a time not permitted, or in a severe-fire-threat area, is an infraction punishable by a $100 fine; Idaho Code 39-2613 makes other violations of the Fireworks Act a misdemeanor, and fireworks used in violation may be confiscated by the authority having jurisdiction.
