Vehicle noise in Idaho Falls is addressed in City Code 5-4-11 (Nuisance Noise, Ord. 3536). Section 5-4-11(C)(5), titled Excessive Vehicle Noise, makes it unlawful to use, operate, or permit to be used, attached, installed, or operated from a vehicle glass-packed mufflers, loud tailpipes, and similar amplified or unamplified sound-emitting devices, modifications, or apparatuses on a motor vehicle that produce plainly audible noise. The code's definitions tie 'vehicle' to the meaning under Chapter 1, Title 49 of the Idaho Code. In addition, 5-4-11(C)(2) extends the 12:00 am to 8:00 am nighttime music ban to parked vehicles, so a car stereo plainly audible overnight is prohibited. The general nuisance rule in 5-4-11(C)(1) also applies to any loud or high-pitched vehicle noise plainly audible at 50 feet. Idaho state law separately requires every motor vehicle to be equipped with a muffler in good working order and prohibits modified exhaust that amplifies noise (Idaho Code section 49-937), which the Idaho Falls Police can also enforce. Local violations are infractions under 5-4-11(F), with a Council-set fine, becoming a misdemeanor after two prior violations within one calendar year.
