Idaho Falls regulates construction noise in City Code 5-4-11 (Nuisance Noise), adopted by Ordinance 3536 (Sept. 14, 2023). Section 5-4-11(C)(6) states that no person shall create, continue, or cause any plainly audible noise within a residentially zoned area from construction activities between 12:00 am and 5:30 am. The exceptions in 5-4-11(D)(4) confirm that construction noise is permitted between 5:30 am and 12:00 am in residential zones, in any area zoned for industrial or manufacturing uses, or where a night construction noise permit has been issued by the Director of Public Works. 'Construction' is defined in 5-4-11(B) as any site preparation, assembly, erection, repair, alteration, or similar action, including demolition. Section 5-4-11(E) allows the Public Works Director to issue a night construction residential-area noise permit, valid up to 14 consecutive days, where the applicant shows unavoidable loss or substantial inconvenience (such as concrete pouring, asphalt, roofing, or heat constraints), holds an issued building permit, and submits a written noise-mitigation plan. The Director must decide within three business days or the permit is deemed issued. Violations are infractions under 5-4-11(F).
