Government Code 65850.3 prevents California cities and HOAs from banning drought-tolerant artificial turf installed at single-family residential properties.
Government Code section 65850.3 bars cities, counties, and charter cities from prohibiting the installation of synthetic grass or artificial turf as a residential drought-tolerant landscape on parcels zoned for single-family residential use. Civil Code section 4735 similarly bars HOAs from banning artificial turf. Local agencies may still impose reasonable design and quality standards but cannot prohibit installation outright. Cities also may not require live grass to satisfy landscape ordinances on these parcels.
Local bans on artificial turf at single-family homes are unenforceable; HOA fines for compliant installations are void under Civil Code 4735.
