The semi-annual cutting schedule (June 15 / August 15) is the operative town standard rather than a fixed inch height like 12-inch ordinances used in many other municipalities. Enforcement is by Code Enforcement; if the owner refuses or fails to abate, the code enforcement officer or chief of police shall proceed to remove the growth, and the cost is charged against the lot and becomes a lien on the property under NCGS Chapter 160D and the abatement provisions of the local code. Apex is in Wake County and follows state nuisance-abatement procedures, with civil penalties cumulative for each day of non-compliance. Upon conviction, the delinquent owner pays a fine of $1.00 for each day any weeds, grass or other noxious growth remains uncut, in addition to any civil penalties levied under the Code Enforcement schedule. If the owner refuses or fails to abate, the Town will mow the property and assess the cost as a lien against the lot enforceable like an ad valorem tax lien. Repeat violations escalate through Code Enforcement and may be referred to Wake County District Court.
