Carmel regulates tall grass and weeds under Chapter 6 (Public Health and Safety) of its City Code rather than under a separate state mowing law. Section 6-88(c) states that all owners of real property located within the City shall cut and remove weeds and other rank vegetation growing thereon that exceeds an average height of six inches, and shall keep their property clear of debris. The six-inch threshold is measured as an average height across the property, so isolated tall stalks may still trigger a notice if the lawn as a whole is overgrown. Carmel's definition of 'weeds' excludes common milkweed (Asclepias syriaca) and swamp milkweed (Asclepias incarnata), so planting native milkweed for pollinators is not a violation. Violations are subject to the general penalties in § 1-11 of the City Code, and each day a violation continues can be treated as a separate offense. Indiana's enabling statute (IC 36-7-10.1) authorizes cities to abate weeds and rank vegetation and recover costs as a lien when an owner fails to comply after notice.
Code Enforcement typically issues a notice of violation directing the owner to mow; if the property is not brought into compliance the City may abate (mow) the property and bill the owner, and unpaid costs can become a lien under IC 36-7-10.1. Violations are also subject to the general penalties in City Code § 1-11, with each day a separate offense.
