The City of Fishers regulates lawn height under Chapter 95 (Trees and Shrubs; Weeds) of its municipal code. Section 95.20 defines 'weeds or other rank vegetation' to include 'grass in excess of eight inches tall' (plus noxious plants listed in IC 15-16-7-2). Section 95.21 makes it the duty of every property owner within the city to cut and remove weeds and rank vegetation 'when such weeds and rank vegetation exceed a height of eight inches, as measured from the ground,' including the portion adjacent to or abutting any sidewalk, alley or street. The eight-inch standard was adopted by Ordinance 120511A (passed 1-3-12) and amended by Ordinance 031819 (passed 5-20-19). Several land types are expressly excluded from the rule under § 95.20: wetlands, woods, nature preserves, undeveloped areas, storm water best management practice areas, agricultural crops such as hay and pasture, and maintained golf-course playing areas. The Fishers Department of Permitting and Inspection administers and enforces this subchapter. If an owner fails to mow, § 95.22 provides for a written notice of violation, and § 95.23 allows the city to enter and mow after a seven-day period, billing the owner for the cost plus fines.
After a written notice of violation, the owner has seven days to mow. Under § 95.23(B), failure to abate makes the owner liable for a fine up to $1,000: at least $250 for a first violation, at least $500 for a second, and at least $750 for three or more. The city may enter and mow, then invoice the owner for mowing costs, administrative costs, and the fine; unpaid amounts can become a tax lien under § 95.24.
