Nevada Assembly Bill 138, signed in 2017 and codified in NRS 533, clarifies that a single-family residence may capture precipitation from its rooftop in a barrel, cistern, or similar structure for non-potable domestic uses such as landscape irrigation, without having to obtain a water right. Prior to AB 138, any diversion was technically subject to Nevada prior-appropriation water law. Henderson does not add restrictions beyond state law, but backflow prevention is required where rain-capture systems connect to any potable or irrigation line under SNWA cross-connection rules. Above-ground barrels should be covered to prevent mosquito breeding and compliant with HOA CC and Rs in master-planned communities like Green Valley, Anthem, and Cadence, which may regulate visible storage. Large cisterns and commercial collection systems exceeding residential scale can trigger State Engineer review under NRS 533.
