Full Breakdown
Henderson Municipal Code § 8.02.130 makes it a misdemeanor to smoke or otherwise consume marijuana in a public place, in a retail marijuana store, or in a moving vehicle, despite Nevada's statewide legalization of recreational marijuana. The Henderson Police Department enforces the ban, with Henderson Municipal Court imposing a fine of up to $600 per violation. The code defines 'public place' broadly as any area the public is invited into or permitted to enter regardless of age, covering streets, parks, parking lots, and sidewalks, but the definition specifically excludes retail marijuana stores themselves.
