When a protected tree must be removed, the developer or owner mitigates by replanting on-site, planting on public property, or paying a fee-in-lieu: $150/inch for 8-18.9-inch trees, $300/inch for 19-25.9-inch trees, and $450/inch for heritage (26+ inch) trees. Routine maintenance pruning of trees on private residential property does not require a permit, but removal of a protected tree on a regulated site does. Texas Local Government Code §250.008 limits how cities may regulate tree removal on residential property, but Cedar Park's ordinance survives by allowing credit for replanting.
Removing a protected tree without approval is a Class C misdemeanor under the City Code with fines up to $2,000 per tree per day. Mitigation may also be required after the fact, multiplying the financial exposure for unauthorized clearing.
