Paramus regulates trimming of street trees and trees in public spaces under Chapter 453, requiring permission from the Shade Tree and Parks Commission before any pruning, planting, or care work occurs in the public right-of-way.
Chapter 453 of the Code, originally adopted in 1952 and amended in 1992, gives the Board of Shade Tree and Park Commissioners exclusive jurisdiction over trees in streets, parks, and other public grounds. Residents and contractors may not prune, spray, treat, or otherwise work on a Borough-owned tree without a permit from the Commission. The Commission considers species, size, age, condition, location, public safety, and the Borough shade tree plan when reviewing requests. Trimming of trees on private developed property generally does not require a permit unless the property is undeveloped or includes a Zoning Board planted buffer area.
Trimming or topping street trees without a permit, hiring an unlicensed contractor for public-tree work, or damaging municipal trees can trigger fines from $200 to $1,500 and replacement assessments based on tree appraisal value.
