Overgrown weeds are handled by the city where you live and, on unincorporated Hamilton County land, by the township trustee and county weed control board under Indiana Code 15-16-8. Noxious weeds and rank vegetation in residential areas are 'detrimental plants' owners must destroy within five days of notice.
Indiana Code 15-16-8 governs destruction of detrimental plants, which include Canada thistle, Johnson grass, Columbus grass, bur cucumber, shattercane, and, in residential areas only, noxious weeds and rank vegetation. Under IC 15-16-8-3, owners must destroy detrimental plants by cutting or mowing and, if necessary, plowing, cultivating, or smothering, or by using chemicals. After written notice, IC 15-16-8-4 gives the owner five days to comply before the township trustee has the plants destroyed and bills the owner. In Hamilton County's cities, the same overgrowth is enforced under municipal rank-vegetation ordinances (Carmel 6-88, Fishers Ord. 120511A). Cities under IC 36-7-10.1 may also abate weeds and rank vegetation and recover costs against the property.
