Amplified music rules in Rogers, AR — also called sound permit, PA system, or live music ordinances — set decibel limits, time-of-day restrictions, and when permits are required.
Rogers, Arkansas regulates amplified music, loudspeakers, and public-address systems under Chapter 18, Article II, Sec. 18-26. Such devices require a police-chief permit and are restricted to 8:00 a.m.-8:00 p.m. in residential zones and 8:00 a.m.-11:00 p.m. (until midnight Saturday) in commercial zones.
The City of Rogers directly addresses amplified sound in the enumerated prohibitions of its noise ordinance (Chapter 18, Article II, Sec. 18-26). The use of loudspeakers, public-address systems, or similar amplifying devices requires a permit from the chief of police. Once permitted, operating hours are limited: in residential zones, amplified sound is allowed only between 8:00 a.m. and 8:00 p.m.; in commercial zones, it is allowed between 8:00 a.m. and 11:00 p.m., extended to midnight on Saturday nights. Beyond loudspeakers, the code restricts radios, phonographs, and similar sound machines from disturbing others between midnight and 7:00 a.m. The ordinance also incorporates an audibility standard: amplified or reproduced sound that is "plainly audible" from 50 feet or more beyond a property's boundary line, or from 30 feet or more from a motor vehicle, can establish a violation. "Plainly audible" is defined as sound clearly capable of being heard by a person of normal hearing, above the level of normal conversation, including bass rhythms. The city amended its noise ordinance to add exemptions for music-based commercial venues such as the Arkansas Music Pavilion (AMP), conditioned on sound-dampening design or topography that limits noise reaching nearby areas. Violations without a stated penalty fall under the Code's general penalty of up to $500 per offense, $1,000 per repetition.
Operating amplified sound without a permit, outside permitted hours, or above the audibility thresholds is enforced by the Rogers Police Department. With no separate penalty stated, the general penalty applies: up to $500 per offense, $1,000 per repetition.
