Henrico County Code Sec. 10-68(2) exempts commercial, industrial and other non-residential noise sources between 7 a.m. and 11 p.m.; overnight they remain limited. Urban-mixed-use commercial establishments are also exempt. Zoning (Chapter 24) governs where industrial uses may operate.
The device-noise prohibition does not apply between 7:00 a.m. and 11:00 p.m. when the source is a recreational or athletic facility or a commercial, industrial, or other non-residential property, and never applies to a commercial establishment in an urban-mixed-use zone. So daytime industrial or commercial operating noise is not a Sec. 10-68 violation, but overnight audible noise in residential areas can be. Where industry may locate is controlled by the Henrico Zoning Ordinance (County Code ch. 24), not the noise article.
Overnight violations are charged under Sec. 10-67 (up to $500, $1,000, then $2,500). Zoning violations are separately enforced under Chapter 24.
