Frequently Asked Questions

Does Henrico's sound-equipment rule apply during the day?
It can. The rule against a device being plainly audible inside another person's home has no time limit; it applies at any hour. The separate 50-foot distance test only applies between 11:00 p.m. and 7:00 a.m. Daytime charges require a police officer to personally witness the violation under Sec. 10-67(b), rather than a magistrate summons.
Are outdoor speakers at a restaurant or bar exempt?
Yes, if the establishment sits in an area zoned urban mixed use, Sec. 10-68(2)(b) exempts it outright. Businesses outside that zoning, along with recreational or athletic facilities, are instead exempt only between 7:00 a.m. and 11:00 p.m.; after 11:00 p.m. the same distance and audibility tests as a residence apply.
What counts as a 'sound-reproducing device' under the ordinance?
The code lists radios, phonographs, televisions, projectors, records, CD players, digital music and MP3 or DVD players, musical instruments, microphones, loudspeakers and sound amplifiers, plus any similar device used to produce or reproduce sound. It applies whether the device is inside a structure or set up outside on one.
