Under the International Fire Code adopted by Pennsylvania, charcoal and LP-gas grills may not be used on combustible balconies or within 10 feet of combustible construction at apartments and multifamily buildings. One- and two-family homes and fully sprinklered buildings are exempt.
Grilling rules come from the PA Uniform Construction Code's adoption of the International Fire Code (Section 308.1.4), not from Lehigh County. At apartments and other multifamily buildings, open-flame cooking devices - charcoal or LP-gas grills - may not be operated on combustible balconies or within 10 feet of combustible construction. Exceptions apply to one- and two-family dwellings, buildings and decks protected by automatic sprinklers, and LP-gas devices using a container of 1 pound or less. Single-family homeowners are generally free to grill in their own yards, keeping a safe distance from the house and following manufacturer instructions. Allentown enforces the fire code through its Fire Prevention Bureau.
Grilling on a prohibited apartment balcony can be ordered stopped and cited under the fire code, and landlords may bar grills entirely; the griller is liable for any resulting fire damage.
