Fontana adopts the 2022 California Fire Code (CFC) under FMC Chapter 14. CFC Β§308.1.4 prohibits open-flame cooking devices (charcoal, wood) and propane tanks larger than 2.5 lbs on combustible balconies or within 10 feet of combustible construction at apartments and condos with three or more units. Single-family backyard grilling is permitted but subject to SCAQMD Rule 444 burn-day rules.
Fontana enforces the California Fire Code (CFC) adopted by reference in FMC Chapter 14 through the San Bernardino County Fire Protection District, which provides contract fire services to Fontana. CFC Β§308.1.4 (carried over from IFC Β§308.1.4 with California amendments) prohibits the use of charcoal burners, open-flame cooking devices, and other open-flame appliances on combustible balconies or within 10 feet of combustible construction in buildings containing three or more dwelling units. LP-gas containers larger than 2.5 pounds are also restricted at multi-family balconies. Exceptions apply where the building is fully sprinklered or only listed electric grills are used. For single-family detached homes, backyard grilling is generally permitted; however, the South Coast Air Quality Management District (SCAQMD) Rule 444 prohibits residential wood burning on declared No-Burn Days during the November 1 β February 28 wood-burning season β this rule covers Fontana because the city sits within the SCAQMD jurisdiction covering the South Coast Air Basin. Outdoor propane and natural-gas grilling are exempt from SCAQMD No-Burn Day rules. During Red Flag fire-weather days, SBCFPD may issue additional restrictions affecting outdoor open flame in WUI (wildland-urban interface) areas of north Fontana near the foothills.
CFC Β§308 violations at multi-family buildings are misdemeanors under FMC Title 1 with fines up to $1,000 and possible immediate removal orders from San Bernardino County Fire. SCAQMD Rule 444 No-Burn Day violations carry administrative penalties up to $500 first offense and $1,000+ repeat. Building owners can be cited for tolerating known violations.
