Madison Fire Code under MGO Chapter 34 adopts the Wisconsin Commercial Building Code (SPS 361-366) and Wisconsin Administrative Code SPS 314 (Fire Prevention) which incorporate the International Fire Code (IFC). IFC 308.1.4 prohibits open-flame cooking devices and LP-gas tanks over 1 pound on combustible balconies of buildings with three or more dwelling units. Charcoal grills must be 10 feet from combustible buildings.
Madison Code Chapter 34 (Fire Prevention) adopts the Wisconsin SPS 314 Fire Prevention Code, which incorporates the International Fire Code. IFC 308.1.4 prohibits open-flame cooking devices (gas, charcoal, electric over 5 kW) on combustible balconies and within 10 feet of combustible construction of buildings with three or more dwelling units. Exceptions exist for buildings fully protected by NFPA 13 or 13R automatic sprinkler systems, and for non-combustible balconies. LP-gas containers exceeding 1 pound capacity are prohibited on multi-family balconies. Wisconsin SPS 340 (LP Gas) provides additional state-level fuel-gas requirements. Charcoal and solid-fuel grills are subject to the same 10-foot clearance from combustible construction. Madison's high-density apartment areas near UW-Madison (Langdon Street, the State Street area, the near-east side near Capitol Square) and the Hub, James, and other downtown student high-rises commonly prohibit balcony grilling through both fire code and lease terms. Single-family detached homes in Atwood, Williamson-Marquette, Sherman, Eken Park, and Westmorland have fewer constraints. Madison's brief but intense grilling season makes summer warnings common; Madison Fire Department conducts public outreach during May and June.
Chapter 34 violations carry forfeitures of $100 to $1,000 per offense under MGO 1.08. Madison Fire Department may issue immediate stop-use orders, vacate orders, and refer cases for prosecution. Wisconsin SPS 314 violations are state-level matters with DSPS enforcement. Multi-family landlords typically include lease termination rights for grill violations. Fires causing damage create civil liability and potential criminal charges under Wisconsin Statute 943.02 (Arson).
