Davie, FL Outdoor Cooking: Smoker Rules (2026)

Charcoal, wood, pellet, and offset smokers used for outdoor noncommercial cooking are permitted at detached one- and two-family homes in Davie, treated essentially like grills under the Florida Fire Prevention Code that the Town's Fire & Life Safety Division enforces. Because a smoker is a cooking device, the outdoor noncommercial preparation of food is exactly the kind of activity Broward County Code of Ordinances section 27-286 allows, provided it does not create excessive smoke or a nuisance - so a smoker that billows heavy smoke toward neighbors for hours could draw a nuisance complaint even though the cooking itself is legal. For apartments, condominiums, and other occupancies that are not one- and two-family dwellings, the same fire-code limits that apply to grills apply to fuel-burning smokers: no charcoal or solid-fuel cooking device may be operated on a balcony, under an overhang, or within 10 feet of the structure, and LP-gas over 1 pound is prohibited above the first floor for gas-fired units. Position smokers on a noncombustible surface well away from siding, fences, and overhangs; never operate a smoker indoors, in a garage, or under a carport; keep a fire extinguisher nearby; and let coals and ash cool completely before disposal in a metal container.
