McHenry County has no ordinance specific to backyard smokers or BBQ pits. Using a smoker to cook is permitted at single-family homes, but persistent heavy smoke drifting onto neighbors can be cited as a nuisance, and apartment balcony use follows the fire code.
Charcoal, pellet, and wood smokers used for cooking are treated like other recreational cooking fires: no permit and no dedicated county rule. A small cooking fire is even excluded from the open-burning restrictions because it burns clean fuel (charcoal or wood) for food, not landscape waste. Two limits apply: (1) smoke that is dense, frequent, or drifts onto neighboring property can be enforced as a nuisance under county public-health provisions or city ordinances; and (2) in multifamily buildings, open-flame and charcoal devices are restricted on combustible balconies under fire code IFC 308.1.4. Keep smokers on a noncombustible surface, away from structures, and attended.
Nuisance smoke can draw a health-department or municipal complaint and abatement order; balcony fire-code violations are enforced by the local fire protection district.
