Within incorporated cities, the adopted International Fire Code restricts open-flame and solid-fuel cooking devices on combustible balconies of apartments, but detached homes are exempt. Commercial pit operations at restaurants face separate fire and air-permit review.
No county penalty applies to home smokers. Excessive smoke may be actionable as a nuisance; multifamily fire-code violations in cities are Class C misdemeanors.
