SCMC 8.16.050 adopts California Fire Code Section 307, and Section 307.6 exempts barbecues, grills, and portable devices used solely for cooking, which includes charcoal, pellet, and offset wood smokers used for food. There is no separate San Clemente residential smoker permit. Operators should place the smoker on a noncombustible surface with clearance from structures, fences, eaves, and vegetation, keep it attended, and have water or an extinguisher nearby. Although cooking devices are exempt from Section 307.6, the fire code official may restrict ember-producing activity when a hazard exists; under Section 305.6, solid-fuel fires are barred when winds exceed 8 mph with humidity below 25% or on Red Flag days, and prudent operators apply the same caution.
A smoker that ignites vegetation or creates a fire hazard violates the California Fire Code adopted as SCMC Chapter 8.16. OCFA may order extinguishment and cite per its fee schedule, each day a separate offense.
