San Clemente declares abandoned, wrecked, dismantled, or inoperative vehicles on public or private property a public nuisance subject to abatement and removal, and separately bans storing any vehicle on a street for more than 72 consecutive hours.
SCMC Chapter 10.52 declares that abandoned, wrecked, dismantled, or inoperative vehicles, or parts thereof, on private or public property (excluding highways) constitute a public nuisance under Government Code 38771. An inoperable vehicle is one that cannot legally be operated on a highway under the California Vehicle Code. The Chief of Police or Director of Building and Planning enforces the chapter, may enter property to inspect, and may abate and remove such vehicles after notice and hearing (SCMC 10.52.060 through 10.52.170), with removal costs recoverable as a lien. Separately, SCMC 10.28.050 makes it unlawful to park any vehicle on a street or alley for more than 72 consecutive hours, the trigger for abandoned-vehicle marking and tow.
Leaving an inoperative or abandoned vehicle can trigger nuisance abatement, towing, and cost-recovery liens; parking any vehicle on a street beyond 72 hours is a citable violation subject to marking and removal.
