Swimming pool permit rules in San Clemente, CA — also covering above-ground pools, in-ground pools, and spa installations — set fencing, barrier, alarm, and inspection requirements.
The San Clemente Building Division requires a building permit (with plumbing, electrical and mechanical trades) to construct a swimming pool, spa or hot tub. Plans on minimum 11x17 sheets, stamped by a licensed engineer or architect, must be plan-checked before any excavation begins.
Pool and spa construction is permitted and inspected by the City Building Division at 910 Calle Negocio (949-361-6100). Under the BI-23 Swimming Pool & Spa Packet, based on the 2022 California codes, plans on 11x17 sheets must show property lines, pool dimensions, setbacks and clearance from structures, barrier fencing and gates, equipment with a noise-containment plan, and easements. Because much of San Clemente sits on expansive soils and slopes, each pool sheet must be stamped by a licensed civil or structural engineer or architect, and shells designed for 100 psf/ft lateral pressure. Pools must be set back from slope tops and bottoms per the grading ordinance. The city administers the statewide Building Code and Pool Safety Act.
Building a pool or spa without a permit is a code violation. The city can issue stop-work orders and require exposure or removal of uninspected work. Barriers must pass inspection before plastering.
