Every San Clemente pool must be fully enclosed by a barrier. The city's BI-17 standard requires a fence at least 60 inches tall with no gaps passing a 4-inch sphere, a bottom no more than 2 inches above grade, and self-closing, self-latching gates that swing away from the pool.
San Clemente enforces the California Swimming Pool Safety Act (Building Code Section 3109) through its BI-17 Pool Barrier Compliance handout. A 'pool' is any pool, spa or hot tub 18 inches or more deep. The enclosure must be at least 60 inches above grade on the side facing away from the pool, allow no 4-inch sphere through openings, and sit no more than 2 inches above grade; landscaping cannot count as the barrier. Horizontal members must be at least 45 inches apart to prevent climbing, and vertical openings may not exceed 4 inches. All gates must open outward and be self-closing and self-latching; a latch below 54 inches must sit on the pool side.
Barriers are inspected before pre-plaster and at final; a pool cannot be plastered or filled until deficiencies are corrected. Owners sign a form promising to maintain the barriers at all times. Failing to maintain a compliant barrier is enforceable.
