San Clemente does not require a building permit for a fence 6 feet or less (masonry under 42 inches), but zoning height limits still apply. Taller front or street-side fences need a Minor Exception Permit.
Under SCMC Section 15.08.025 (adopting the California Building Code with local amendments), a building permit is not required for fences other than swimming-pool barriers that are not over 6 feet high, or for masonry fences under 42 inches above finish grade. A permit exemption does not waive the zoning height limits in SCMC 17.24.090, which still cap front-yard fences at 3 feet 6 inches. To raise a front-yard or street-side fence above the standard limit (to a maximum of 6 feet), a Minor Exception Permit is required under SCMC 17.16.090. Enclosing the rear half of a lot with a fence taller than 6 feet around a tennis court or screened outdoor area requires a Conditional Use Permit under SCMC 17.16.060.
Building a fence that exceeds zoning height limits, or that needs a Minor Exception or Conditional Use Permit, without approval is a violation. Contact the Community Development Department (949-361-6100) before building; non-compliant fences may need to be modified or removed.
