In San Clemente only the City Traffic Engineer may paint curbs to mark parking restrictions; red curbs mean no parking, and unauthorized private curb painting is not recognized as an enforceable restriction.
SCMC 10.28.040 authorizes red curb paint (and signs) to designate no-parking and no-stopping zones, including near crosswalks, safety zones, and traffic-hazard areas, and provides that parking is prohibited where such red paint appears. SCMC 10.28.045 directs the City Traffic Engineer to erect signage and paint curbs where necessary to identify Council-established restricted parking areas, both on-street and off-street; parking against any such curb marking is unlawful. SCMC 10.28.210 gives the Traffic Engineer authority to install painted parking-space markings, within which vehicles must park. The code does not define yellow, white, green, or blue curb colors, which follow California Vehicle Code Section 21458. Private curb painting is not an enforceable restriction.
Parking against a lawfully painted red or restricted curb is a citable violation; only the City Traffic Engineer may authorize curb markings, so private curb painting carries no legal force.
