San Clemente allows construction noise only 7:00 a.m. to 6:00 p.m. Monday through Friday and 8:00 a.m. to 6:00 p.m. Saturday, with no construction on Sunday or City-recognized holidays, under SCMC §8.48.090(E).
Section §8.48.090(E) exempts construction-activity noise from the general noise limits only if work occurs 7:00 a.m. to 6:00 p.m. weekdays, 8:00 a.m. to 6:00 p.m. Saturday, and at no time on Sunday or a City-recognized holiday; grading must also comply with SCMC §15.36.190. "Construction activity" under §8.48.020 includes demolition, repair, remodeling, excavation, grading, equipment delivery and running construction equipment. Real-property maintenance follows similar hours under §8.48.090(G). A short-term permit for urgent public-health/safety work (up to three days) or for work the City finds will not impair health or safety may be granted under §8.48.090(F). Outside the permitted hours, construction noise must meet the standard dB(A) limits of §8.48.050.
Construction outside exempt hours loses its exemption and becomes subject to the §8.48.050 limits. Per SCMC §1.16.010, violations are misdemeanors (up to $1,000/six months) or infractions ($100/$200/$500), with each day a separate offense; administrative fines also apply.
