Amplified-sound rules moved from old §8.48.080 to zoning §17.24.055 (Ord. No. 1717, 2021). "Amplified sound" means any sound whose volume is increased by an external aid; unaided shouting, chanting or acoustic instruments are exempt but still subject to Chapter 8.48. Using amplified sound within a business, restaurant or bar is not permitted except under a Minor Conditional Use Permit issued per §17.16.070. No such permit may allow amplified sound in a residential zone or on residential property (§17.24.055(C)). Permitted amplified sound must meet the §8.48.050 and §8.48.060 noise limits, but measured with C-weighting and denoted dB(C). Permit conditions may cap hours, require doors and windows closed, and demand acoustical-consultant proof of compliance.
Operating amplified sound without the Minor CUP, or exceeding permit conditions or dB(C) limits, violates the code and is enforceable under SCMC §1.16.010 (misdemeanor up to $1,000/six months or infraction $100/$200/$500), plus fines and permit revocation.
