Brooklyn driveways require a DOT curb-cut permit. Blocking a legal driveway is illegal, but bogus curb cuts are not enforceable. Homeowners cannot reserve street space in front.
Driveways in Brooklyn are heavily regulated because off-street residential parking is scarce and valuable. Creating a new driveway or curb cut requires a DOT permit under Rules of the City of New York Title 34 and NYC Admin Code Β§19-136. Curb cuts must be on properties that zoning permits (R1 through R5 lower-density districts, plus certain corner lots), cannot cross a bus stop or hydrant frontage, and cannot exceed zoning-district-specific widths (commonly 10 to 20 feet). Unauthorized curb cuts β common in parts of Brooklyn where owners paint 'No Parking' on the curb without a permit β are illegal and the NYC 'Bogus Driveway' enforcement initiative allows residents to park across them. Under VTL Β§1202(a)(3) and NYC Traffic Rules Β§4-08(e), it is illegal to block a legal driveway, but a private vehicle belonging to the property owner can block their own driveway for up to 3 hours. Homeowners cannot reserve the street space in front of their curb cut for themselves. DOT enforces through sign posting, 311 complaints, and ticketing.
Blocking legal driveway: $95 ticket, towable. Unauthorized curb cut: $500+ DOT fine plus required restoration at owner cost. Commercial driveway unauthorized use: $165.
