Under the California Building Code as adopted by San Diego County, decks and platforms not more than 30 inches above adjacent grade at any point and not over any basement or story below are exempt from building permits. Decks above 30 inches require permits with structural plans, guardrails (42 inches per California code), and inspections. Covered patios (patio covers, pergolas with roofing) attached to the house are considered additions and require building permits. Freestanding shade structures under 120 square feet with no utilities may be exempt. Setback requirements apply to all outdoor structures. At-grade patios (concrete, pavers, natural stone) do not typically require permits. In hillside and fire-prone areas, additional engineering and fire-safety requirements may apply to decks. The county's online permit system allows some permit types to be submitted electronically.
