Davis limits residents to no more than three garage or yard sales per calendar year, each lasting at most two consecutive days, between 8:00 a.m. and 5:00 p.m. Only personal property may be sold, not resale goods.
Under Davis Municipal Code special-use provisions (Article 40.26), a residence may hold no more than three sales in any calendar year, and each sale may run no more than two consecutive days, starting no earlier than 8:00 a.m. and ending no later than 5:00 p.m. Property sold must be the household's own personal property; secondhand goods obtained for the purpose of resale are not allowed, which keeps garage sales from becoming ongoing retail operations. Temporary garage-sale signs of up to nine square feet may be placed in the public right-of-way only on the day of the event and must be removed within 24 hours (DMC Chapter 3, Advertising). No business license is required for a compliant residential garage sale.
Exceeding three sales per year, running longer than two days, selling resale merchandise, or operating outside 8 a.m.-5 p.m. can be cited as a zoning violation. Illegally posted or unremoved signs may be removed by the city
