Davis Municipal Code 40.27.060 measures a fence on top of a retaining wall from the lowest existing grade within a three-foot radius to the highest point of the fence on the high side of the wall.
Under DMC 40.27.060, the height of a fence placed on top of a retaining wall is measured from the lowest existing grade point within a three-foot radius of any point on the fence to the highest point of the fence on the high side of the wall. This rule prevents stacking a retaining wall and fence to circumvent the seven-foot maximum height. The standard fence and wall limits still apply: seven feet behind the required front yard setback, four feet in any required yard, and six feet at the reduced front and street-side setbacks. Structural retaining walls are also subject to the city's building-permit and engineering requirements administered by the Building Division.
A fence-on-retaining-wall combination that exceeds the measured height limit under DMC 40.27.060, or a retaining wall built without required permits, may prompt code enforcement action or removal.
