Dog vocalization is a prima facie violation when it continues, in excess of the allowable decibel limit, for more than three out of five minutes on a sustained basis during a ten-minute measurement between 9:00 p.m. and 7:00 a.m.; or more than five out of ten minutes during a fifteen-minute measurement between 7:00 a.m. and 9:00 p.m.; or for fifteen minutes of sustained vocalization, and the sound is audible within another owner's property plane. If the animal's owner is unavailable, notice may be given to someone at the residence or posted on the premises.
A prima facie barking violation is an infraction on the first two offenses within a year, fined under Government Code 36900(b); a third within a year is a misdemeanor. Notice may be posted if the owner is absent.
