Davis requires property owners to control weeds, dry vegetation and overgrown grass. Conditions violating weed and rubbish abatement law are declared nuisances under Article 23.01 and enforced by Code Enforcement.
DMC Article 23.01 lists conditions in violation of weed and rubbish abatement laws, defined at California Government Code Sections 39501 et seq., among declared public nuisances. Owners and occupants must remove weeds, tall grass, dry brush and combustible vegetation that create fire hazards, harbor pests, or reduce neighborhood appearance as viewed from the public right-of-way. Overgrown vegetation is one of the most commonly cited conditions in Davis. Code Enforcement responds to complaints, issues a Notice of Violation with a deadline to cut and clear the vegetation, and re-inspects. If the owner fails to comply, the city may perform weed abatement and recover its costs against the property. Fire-season clearance around structures is also encouraged for wildfire safety.
A Notice of Violation sets a cutting deadline. Uncorrected or repeat weed violations within 12 months bring citations of $100, then $200, then $500. The city may abate the weeds and lien the cost
