DeSoto County municipalities enforce property maintenance codes against garage sales that create blight. Merchandise must be displayed neatly, stored out of view after hours, and signs removed within 24 hours of the sale's end.
Southaven Code Ch. 38, Olive Branch Code Ch. 34, Horn Lake Code Ch. 30, and Hernando Code Ch. 30 all apply nuisance and property maintenance provisions to garage and yard sales. Merchandise cannot be strewn across the front yard; tables, racks, and display items must be removed or stored out of public view at the end of each sale day. Unsold items may not be left at the curb or visible from the street between sale days or after the sale concludes. On-site signs must be removed within 24 hours of sale closure. Off-premise directional signs placed in the public right-of-way are impounded by code enforcement and MDOT crews. Properties that develop recurring visible clutter receive escalating blight citations. Unincorporated areas are enforced by DeSoto County Code Enforcement under the county Planning Ordinance.
Items left after sale: $50 to $200 blight citation. On-site signs not removed: $25 to $50 per sign. Off-premise ROW signs: impoundment without notice. Habitual violations: escalating fines up to $1,000.
