Southaven, MS Noise Ordinances: Construction Hours (2026)

Sec. 4-3(a) limits construction activities in the City of Southaven to 7:00 a.m. to 7:00 p.m., and the stated purpose is to minimize impacts on the quality of life for adjacent property owners. The section prints one daily window and no separate weekday or weekend hours.

Two exclusions sit in subsection (b). The section does not apply during the period of time that a declaration of emergency has been issued by the Governor of Mississippi or the mayor of the city. It also does not apply to work conducted by government entities or their contractors on public roads or projects within the public right-of-way.

Subsection (c) gives private builders an exemption route. The city building official can approve days and hours of operation different from the section after reviewing a written request from the developer, architect, engineer, or contractor of record. The request must include three things: the challenge or challenges prohibiting normal days and hours of operation, the means of mitigation of excessive noise, dust, traffic, light or any other nuisance, and the projected duration for alternative scheduling. A request that names a schedule but leaves out the mitigation plan or the duration does not meet the printed list.

Subsection (d) provides that the city police or the city building official can enforce the section, so a complaint about early or late work can go to either. Subsection (e) attaches the consequences: a violator is subject to the maximum penalties authorized by Mississippi law, revocation of the construction permit, and an immediate stop work order. The permit at risk is the one Sec. 4-27 requires before any building, fence, sign, swimming pool or other structure is erected or altered. The provision carries the history note Res. of 3-17-26(1), so it is a recent resolution rather than a decades-old rule.
