Birmingham Code Β§14-1-1 et seq. requires residents to store trash and recycling carts behind the dwelling, in a garage, or screened from street view between collection days. Carts may be placed at the curb no earlier than 6 PM the evening before collection and must be retrieved by midnight of the collection day. Lids must remain closed; overflowing bins violate sanitation code. The Department of Public Works conducts complaint-driven enforcement. Unincorporated Jefferson County uses subscription trash service through private haulers (Waste Management, Republic) and has less strict storage rules though general nuisance provisions apply. Hoover, Vestavia Hills, and Mountain Brook each have separate, often stricter, bin storage ordinances. HOAs typically require full concealment.
First offense: warning from code enforcement. Subsequent violations: $25-$100 fines per occurrence in Birmingham. Persistent violations: referred to Municipal Court. HOA violations enforceable separately.
