Colusa County Code Chapter 32 (Solid Waste Management) governs containers in unincorporated areas. Section 32-2(b) requires every waste generator to provide covered, leak-proof containers, and Section 32-2(d) makes the owner or occupant responsible for safe, sanitary storage that does not create a nuisance, attract vectors or cause odors.
Under Chapter 32 (Ord. No. 452), a "container" must be durable, corrosion-resistant, nonabsorbent, leak-proof, watertight, odor-proof and rodent-resistant with a fly-tight cover (Sec. 32-1(d)(6)). Every person generating refuse must provide containers of adequate size and number, and they must be covered unless waived by the environmental health division (Sec. 32-2(b)(1)). Individual storage containers shall not exceed 32-gallon capacity or weigh more than 60 pounds when filled, except where mechanical (cart) systems are approved (Sec. 32-2(b)(2)). Containers must be stored to prevent upset and spillage and may not be stored below ground level (Sec. 32-2(b)(6)). Section 32-2(d) makes the owner, operator or occupant responsible for safe and sanitary storage of all solid waste until legally removed, and prohibits storage that causes health hazards, attracts vectors or pests, creates unpleasant odors, or creates a nuisance. Note that Recology Butte Colusa, the County's franchise hauler, supplies its own 32-, 64- and 96-gallon carts, which fall under the mechanical-system exception. Letting overflowing or improperly stored bins accumulate can also be cited as a public nuisance under Chapter 42.
Improper container storage is enforced by the County environmental health division and public works department (Sec. 32-1(c)). Section 32-9(a) declares storing or disposing of solid waste in violation of the chapter a public nuisance that may be abated by any appropriate proceeding under state or county law. Nuisance bins may additionally be cited under Chapter 42's administrative process, which carries infraction fines and daily civil penalties.
