Pierce County Code 8.08.050(F) makes property where solid waste has accumulated a public nuisance unless the waste is securely stored in receptacles designed to prevent threats to health, safety or the environment. Curbside carts in unincorporated areas are supplied by the WUTC-certificated hauler serving each area.
PCC 8.08.050(F) declares as a nuisance any property where solid waste has accumulated or is handled, stored or buried except at permitted facilities, and it exempts "solid waste securely stored in receptacles or containers designed to prevent threats to human health or safety or to the environment until such solid waste enters a solid waste handling system." In unincorporated Pierce County, garbage and recycling carts are provided by the certificated hauler (Murrey's Disposal, LeMay Pierce County Refuse, American Disposal or DM Disposal), which are WUTC-regulated under RCW 81.77. PCC 8.29.030 requires an approximately 96-gallon wheeled recycling cart, with a 65-gallon option on request. Overflowing or improperly stored waste can be cited as an accumulation nuisance.
Accumulation not stored in adequate containers is a per se nuisance under PCC 8.08.050(F), abatable through code enforcement at the owner's cost. Carts lost or damaged by customer negligence are replaced at the customer's expense per PCC 8.29.030(B)(5).
