Cupertino Municipal Code Chapter 9.08 declares hazardous weeds and combustible vegetation a public nuisance and requires property owners to remove them. Abatement is administered through the Santa Clara County weed-abatement program, with the City able to remove growth and lien the property if owners do not comply.
Under CMC 9.08.010, weeds are declared a public nuisance for fire-safety and health reasons. Each year the City Council declares that 'the growth of weeds, the accumulation of garden refuse, cuttings and other combustible trash' on listed private properties is a public nuisance and orders abatement. Owners get written notice and a hearing date and may destroy or remove the weeds and debris themselves by cutting, discing, chemical spraying, or another approved method. If they do not, the County's Hazardous Vegetation Management Program abates it and the cost becomes a special assessment or lien on the parcel. Vegetation obstructing the public right-of-way is separately covered by CMC 14.08.220, giving owners five business days to remove obstructions after notice.
