Jackson County, MS Rental Property Rules: Just Cause Eviction (2026)

Mississippi does not impose just-cause eviction requirements at the state or local level, and Jackson County has not enacted any protective ordinance. Under MS Code §89-7-27, landlords may serve a 3-day notice to pay rent or vacate for non-payment. For lease violations other than non-payment, MS Code §89-8-13 allows a 14-day notice to cure or 30-day notice to terminate. For month-to-month tenancies, MS Code §89-8-19 requires 30 days' written notice for no-cause termination. Fixed-term leases expire on their termination date without additional notice required. Evictions are filed in Jackson County Justice Court for Pascagoula, Moss Point, Gautier, and unincorporated areas. Self-help evictions, such as changing locks, removing tenant belongings, or shutting off utilities, are prohibited under MS Code §89-7-3, with tenants entitled to damages and attorney's fees. Retaliatory evictions after habitability complaints are prohibited under MS Code §89-8-17. Federal Fair Housing Act protections and CARES Act provisions for federally backed properties still apply.
