Yuba City Municipal Code Title 3, Chapter 6, Article 4 defines a 'transient' as a guest staying 30 consecutive days or less; rentals of 30 days or more are not subject to the 10% TOT and are treated as residential tenancies under California Civil Code §1940 et seq. There is no annual night-cap on hosted or unhosted STRs (unlike Los Angeles' 120-night cap or San Francisco's 90-day unhosted cap), and the Municipal Code imposes no limit on how often a host can list a unit. Extended home shares (rentals of 31 days or more) are permitted by right in any zone that allows residential use, including in ADUs and JADUs - the city's ADU ordinance (Ord. No. 006-22) explicitly requires that ADU and JADU rentals be 30 days or longer, mirroring Gov. Code §65852.2(a)(6). Once a stay exceeds 30 days, AB 1482 statewide rent caps (Civ. Code §1947.12) may apply if the tenant remains 12+ months (with limited single-family exemptions).
Because no night-cap exists, there are no exceedance penalties. Failure to treat a 30+ day occupant as a tenant (e.g., refusing required notices, lockouts) is a violation of Civ. Code §§1940-1954 enforceable in civil court. TOT misreporting for stays straddling the 30-day threshold is penalized 10% plus 0.5%/month interest under Title 3, Ch. 6, Art. 4.
