Oakland Municipal Code Title 5 Chapter 5.51 distinguishes hosted from un-hosted STR operations. For hosted rentals, the host must occupy the dwelling overnight while a paying guest is present. Un-hosted rentals are permitted only at the operator's primary residence and only when the operator is temporarily absent. Operators must register with the City and post the permit number on every listing. Hosting a stranger while away from the property without registration triggers immediate enforcement and platform delisting.
Operating an un-hosted STR without a permit, or hosting at a non-primary residence, may result in citations, civil penalties, and permit revocation under OMC 5.51.
